Kindred: Family Cookbook – Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using Kindred: Family Cookbook ("the App"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you must not use the App. Continued use of the App constitutes acceptance of any updated Terms posted within the App or on our website.

2. Eligibility

You must be 13 years of age or older to use the App. By creating an account, you represent that you meet this requirement and have the legal authority to accept these Terms.

3. Account Registration and Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify Egregius Digital immediately if you suspect unauthorized access or security breaches. We are not liable for any loss or damage resulting from your failure to safeguard your account credentials.

4. License to Use the App

Egregius Digital grants you a personal, limited, revocable, non-transferable, and non-exclusive license to install and use the App for personal, non-commercial purposes in accordance with these Terms. We reserve all rights not expressly granted.

5. User Responsibilities

You agree to use the App only for lawful purposes and in a way that does not infringe the rights of others or restrict their use and enjoyment of the App. You may not:

• Reverse engineer, modify, or distribute the App or its content except as expressly permitted.
• Attempt to gain unauthorized access to any systems or networks connected to the App.
• Use the App in a way that could damage, disable, or impair its operation.

6. Recipe Ownership and Contribution

When you contribute a recipe or other content to a shared cookbook, you confirm that:

• You own or have the right to share that content.
• You grant all current and future members of that shared cookbook a perpetual, non-exclusive, royalty-free license to use, modify, reproduce, and display that content within the App.
• Recipes and associated photos contributed to a shared cookbook remain with the group even if you leave or delete your account.
• You understand that removing your account will not remove recipes you have shared in collaborative cookbooks. This approach preserves family collections and ensures that group cookbooks remain intact for all participants.

7. Subscriptions and Payments

Some features require a paid subscription. Prices and available plans are displayed within the App and may vary by region or platform. All subscription transactions are processed through Apple App Store or Google Play, and refunds are governed by those stores' refund policies. From our perspective, all purchases are final, but you may contact the appropriate store for assistance with billing issues.

8. Third-Party Services

To provide full functionality, the App relies on secure third-party services including (but not limited to):

• Firebase / Google for authentication, storage, analytics, and messaging
• RevenueCat for subscription management
• Apple and Google for sign-in and payment processing

By using the App, you acknowledge and consent to the sharing of necessary personal data with these third parties as described in our Privacy Policy.

9. Data Integrity and Storage

Egregius Digital will take reasonable measures to protect your data and preserve it against loss or corruption. However, you acknowledge and agree that:

• The App and its content are provided "as is" and "as available."
• Egregius Digital does not guarantee uninterrupted access or permanent data retention.
• The admin of a cookbook may delete your submitted recipes without your knowledge or consent.
• You absolve Egregius Digital of financial responsibility for any accidental data corruption, alteration, loss, or deletion.

10. Termination and Suspension

We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or illegal activity, or compromised the security or integrity of the App. Upon termination, your license to use the App immediately ceases, but data already shared in family cookbooks will remain with those groups as described in Section 6.

11. Limitation of Liability

To the fullest extent permitted by law:

• Egregius Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits arising from your use of the App.
• Your sole and exclusive remedy for dissatisfaction with the App is to stop using it.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you.

12. Disclaimer ("As-Is" Clause)

The App is provided "as is" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. Egregius Digital makes no guarantee that the App will meet your requirements or operate without interruption or errors.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. You agree that any dispute arising from or relating to these Terms or your use of the App shall be brought exclusively before the courts of Alberta, Canada, and you consent to their jurisdiction and venue.

14. Changes to These Terms

We may update these Terms from time to time. Updated versions will be posted in the App or on our website, and the "Effective Date" will be revised. Continued use of the App after such updates constitutes acceptance of the new Terms.
